Felony DUI Charge

If you are stopped by a Police Officer, Sheriff’s Deputy , College Police Officer or State Trooper and arrested for DUI and it’s your 4th DUI or more in 10 years, it is considered a felony DUI charge. There are mandatory steps that will occur if you are found guilty or pled guilty to DUI.

The State of Georgia mandates one year to five years in prison. The Judge can stay or probate all of the jail time, but 90 days. You will get a minimum of 12 months of probation, minus any jail time given by the Judge. A minimum of 60 days (480 hours) of community service. Complete an alcohol and drug evaluation and any recommended treatment. Complete the risk reduction course (also known as DUI school). Complete the MADD victim impact panel . The fine will be a minimum of $1,000 and a maximum of $5,000. There will also be a monthly probation fee. The fee depends on each court system, since most are private companies.
