In Georgia, there are two degrees of Homicide by Vehicle, first degree and second degree
The most severe is Homicide by Vehicle in the First Degree. This is a felony offense that carries a minimum of three years in prison to a maximum of fifteen years in prison.
Any person who, without malice aforethought, causes the death of another person in violation of the charges of

- Drugs
- Reckless Driving
- Passing a School Bus
- Fleeing or Attempting to Elude
- Hit and Run
Violation of any other traffic law and you could be charged with Homicide by Vehicle in the Second Degree. This is a misdemeanor charge that carries a maximum sentence of 12 months in jail.
